New Proposed ‘Housing and Productivity Contribution Scheme Works-in-Kind Guideline’

On 1 October 2023, the NSW Government introduced the Housing and Productivity Contribution Scheme (HPCS), which enables the NSW Government to collect housing and productivity contributions from residential, commercial, and industrial developments to fund state and regional infrastructure within the following regions:

Central Coast
Greater Sydney
Illawarra-Shoalhaven
Lower Hunter

Under Part 3 of the Environmental Planning and Assessment (Housing and Productivity Contributions) Order 2024 (HPC Order), housing and productivity contributions are ordinarily made as monetary contributions. However, clause 18(2) permits developers, by agreement with the Minister, to dedicate land or carry out capital works (or both) for regional infrastructure (Works-in-Kind), in whole or in part, as an alternative to meeting their monetary contributions. An Overhaul of the Taxation Scheme: Developments for Developers

In July 2023, the NSW parliament passed the Environmental Planning and Assessment Amendment (Housing and Productivity Contributions) Act 2023 (NSW), which introduces Housing and Productivity Contribution (HPC). HPC replaces the previous Special Infrastructure Contribution (SIC) scheme and applies a more consistent contribution framework over a much wider area, including the entire Local Government Areas located in:

the Greater Sydney region;
the Illawarra-Shoalhaven region;
the Lower Hunter region; and
the Central Coast region.

The HPC will apply from 1 October 2023, except in relation to land within the Western Sydney Growth Areas and Western Sydney Aerotropolis SIC areas (to transition to the HPC regime by 2026). [...] READ MORE →

This is my first time in transacting with Matthewsfolbigg which I did while purchasing a property. My dealings were mainly with Jeannette Limbo who went above and beyond any other solicitor that I have used when transacting for a property. At every stage I was contacted by Jeanette to update me personally and follow up with an email. She is unbeleivably pleasant, easy to work with, meticulous and takes her work to heart. As an example, our settlement was to take place at 2:30 on the Friday. It was imperative that we settle on Friday but we hit a technical snag at our bank. Jeanette spent the whole day on the phone with the banks and the other solicitor to try to get things done and stayed after work on a Friday until we finally settled. It was really nice to see how happy Jeannette was when it was done, we were definately not a number. We were a person who needed the job done.
