Some people ask why they should have a Will when it can be contested.  A Will is still the best option in ensuring your estate is distributed as you wish.

Without a Will you will not have any say in how your estate is distributed.

Under NSW law, only certain people are entitled to challenge a Will.

Even if a person makes a claim, it is a matter for the Court to decide whether to change the Will or not.

If the Court decides to alter the Will, the Court will not change the Will anymore than what is necessary – that is, the Court won’t necessarily re-write the Will altogether.
